 This Agreement shall define the participants, price that will be paid, and the services that will be provided.

This agreement is for 150-day enrollment in First Time Home Buyers, herein referred to as “Company” and   Signatory herein referred to as “Client”.

  

FEES:

Enrollment Fee 

A specified enrollment fee of $299 per individual or couple shall be charged on all new Agreements.  

RECITALS

First Time Home Buyers has certain knowledge and expertise in assisting and helping them to become ready to be homeowners. Therefore, Client desires to engage Company to provide services set forth below.

SERVICES PROVIDED

Assist the client in obtaining a copy of credit report if needed.
Analysis and review of client credit report.
Locate HUD Homebuyer Education class near the client.  Near for this agreement means 50mile radius from clients home or center of the desired municipality. 
Assist in obtaining preapproval from mortgage lenders, if needed.
Assist in locating licensed realtor.
Processing Request to eliminate erroneous and outdated technical Data on credit reports; including but not limited to: Addresses, Date of Births, Social Security Numbers, First Names, Last Names, Employment Data etc.
Processing of Company Specific Documents and/or files.

In the event that the Client is utilizing Company’s services as part of the Client's dealings with a Mortgage Broker or Real Estate Agent, the Client authorizes the Mortgage Broker or Real Estate Agent to disclose the Client's financial history and credit report(s) to Company and also authorizes Company to disclose the Client's financial information and credit report(s) to said Mortgage Broker or Real Estate Agent. 

Disclaimer of Guarantee or Warranty: 
Company agrees only to perform the services specifically described in this Agreement. Client recognizes that every consumer’s circumstances are different and that Company does not represent or warrant that it will achieve specific results for the Client. The Company does not represent or guarantee that the Client will receive new credit or loans, credit cards, or mortgages as a result of Company’s services.

Conflict of Interest:
Client warrants to Company that it does not currently represent or promote any lines or products that compete with the Company’s Products.  

Indemnification:
Client agrees to defend, indemnify and hold Company and its members, managers, employees and agents harmless from and against any and all claims, demands, actions, liabilities, costs or damages arising out of services to the Client under this Contract or the Client's breach of this Contract, except for claims, demands, actions, liabilities, costs or damages arising out of Company’s gross negligence or willful misconduct. The Client further agrees to pay Company’s reasonable attorney’s fees and costs arising from any actions or claims eligible for indemnification under this Contract.

Limitation on Liability:

 In the event of termination by either party in accordance with any of the provisions of this Agreement, neither party shall be liable to the other, because of the termination of compensation or reimbursement or damages on account of the loss of prospective profits or anticipated sales or on account of expenditures, investments, leases or commitments in connection with the business

Confidentiality:

 Client acknowledges that by reason of its relationship to Company hereunder it will have access to certain information and materials concerning Company's business plans, clients, technology, and products that is confidential and of substantial value to Company, which value would be impaired if such information were disclosed to third parties. Client agrees that it shall not use in any way for its own account or the account of any third party, nor disclose to any third party, any such confidential information revealed to it by Company. Company shall advise Client whether or not it considers any particular information or materials to be confidential. 

Legal Expenses:

The Client in any legal action brought by one party against the other and arising out of this Agreement shall not be entitled, in addition to any other rights and remedies it may have, to reimbursement for its expenses, including court costs and attorneys' fees

Client Obligations & Agreement:  

A. Client agrees to maintain on-time monthly payments of their current credit obligations. (i.e. – car loan, utility bills, mortgage payments, credit cards, etc.) 

B. Client agrees to payment terms and conditions as chosen in Exhibit A which is incorporated into this agreement.

  1. Client agrees that contact was initiated by the client by either calling Company or opt-in form online.

The laws of the State of Michigan shall govern the validity, performance, and enforcement of this Agreement. Any forbearance or failure by either of the parties to exercise any right, power, or remedy under this Agreement shall not be deemed to be a waiver of such right, power, or remedy, and any Single or partial exercise of any such right, power, or remedy shall not preclude the further exercise thereof; every right, power, or remedy of either party shall continue in full force and effect until such right, power, or remedy is waived specifically by an instrument in writing executed by such party.

Client Agrees and understands that Client has three days to cancel this agreement and that no refund shall be given after the three days have expired.

ACCORDINGLY, First Time Home Buyers and Client have executed this Agreement as of the date first written above and agree to all terms and statements made herein.

When submitting documents online, the Client agrees that his/her digital signature is     
      equivalent to a handwritten signature as provided in The Federal E-Sign Act.

 

Notice of right to cancel: You may cancel this Agreement, without penalty or obligation,

 within Three (3) days or 72 hours after the date your enrollment payment is received.   


I authorize  First Time Home Buyers - Xanadu Program to bill me $299 per agreement.

 

The name, address, and phone number provided above is true, and verified by myself, I have read and agree to the terms of service above and I authorize First Time Home Buyers - Xanadu Program to bill me $299 per individual, shall be charged on all new Agreements.   I understand if I would like to cancel I need to speak directly to the Billing Dept by calling (888) 213-7774. I understand I must allow at least 48 hours before my billing date to avoid new charges when canceling.
